A professional is a person appointed by a local court to manage the affairs of a person, protecting the rights of the individual, property, or both. All guardians are required to be fingerprinted, have criminal/credit history investigations performed, provide a blanket bond, and update continuing education credits yearly.

When it is obvious, your loved one lacks the capacity to make responsible decisions concerning personal health and/or finances due to increasing signs of dementia.

Professional guardians are appointed by the court and governed by Florida law. The court, after careful evaluation of the person in need, decides what authority a guardian shall have. Guardians of property are required to post a bond, usually equaling the assets being managed. A detailed inventory is required to be filed within 60 days. The guardian must file with the court an annual accounting detailing all monies received and disbursed. This is just a sampling of the safety measures to protect individuals and their property by using a professional guardian.

A document called a “Power of Attorney” gives another individual the legal means to act on another’s behalf. A power of attorney has no requirements for reporting or accounting to any independent authority. Also, there are no insurance or bonding requirements for power of attorney. Extreme caution should be used before entering into this type of agreement because it lacks safeguards for individuals.

No, a person who has full capacity and would like someone to manage their financial/property affairs can enter into a Voluntary Guardianship. Choosing this type of guardianship requires a physician’s statement indicating the person has the capacity and understands the nature of the voluntary guardianship.
